Pistol Brace Regulation May Be Here; What Do You Need To Do?

The 52-page rule 2021R-08, signed by the Attorney General in June 2021, set to go into effect last August, may come to the land this month if approved. Some say it is a done deal; others seem to think it is all but forgotten. From the many federal law enforcement friends contacting me about this happening and what they can do, I think it may be right around the bend. What does this mean for the almost 40 million people who could become felons overnight? Be prepared. That is why they are calling me, a 20 plus year lawyer and 07/02 FFL firearms manufacturer and dealer, who has been doing NFA trusts for years and teaches about the laws to many other lawyers across the state.

Most know me as an Assistant District Attorney for 17 years prior to retiring June 2018. Ronnie. As most prosecutors do, I attended the Annual Criminal and Civil Law Update presented by the Texas District and County Attorney’s Association(TDCAA) each year to meet the minimum required Continuing Legal Education (CLE) needed for an attorney to retain their Bar License, which is 12 hours CLE and 3 hours ethics.

The ATF issued a new comment request for proposed modifications to ATF 5320.4, also known as Form 4. This form is used for the application for transfer of an NFA item to an individual or trust.

2019 Texas Warrant Roundup

Each year some 300 state agencies and federal law enforcement agencies take to the streets looking for individuals with outstanding Class C warrants. Some municipalities, like the City of Conroe this year, provide an amnesty program in February to pay reduced fees to close the cases…This year the amnesty program ends February 28th.

ATF Updates Mailing Addresses

As of February 1, 2019, the ATF has issued a statement on their Webpage informing those who have the NFA affliction there has been an address change to where forms are to be mailed. The new forms, such as Form 1 or Form 4, etc have been updated if you download the new forms here https://www.atf.gov/resource-center/forms-library

DPS Cracks Down on Move Over / Slow Down

On January 16, 2019, Texas DPS said they are ramping up the enforcement of the the Move Over/Slow Down statutes across the great state of Texas. According to DPS records, DPS issued more than 41,000 warnings and citations to motorists who were alleged to have violated the law in 2018.
